1) About Us

“My Samoa”, “we”, “us”, and “our” refer to the operator of the website www.mysamoa.co
 and related services (including vouchers, marketplace ordering, and delivery/pick-up coordination in Samoa). Contact: support@mysamoa.co

2) Acceptance of Terms

By accessing or using our website, creating an account, or placing an order, you agree to these Terms & Conditions (the Terms). If you do not agree, please do not use the site.

3) Key Definitions

Customer, you, your: the person using the site or placing an order.

Marketplace Vendor/Vendor: a third-party seller listed on My Samoa.

Voucher: a digital voucher redeemable with participating stores (e.g., supermarkets, restaurants, service providers) in Samoa.

Receiver: the person in Samoa who picks up or receives the order or voucher items.

Delivery Partners: third-party logistics and riders/couriers.

4) Eligibility & Accounts

You must be 18+ to create an account or place orders.

Provide accurate, complete information and keep your login secure. You’re responsible for activity under your account.

5) Our Services

My Samoa is a marketplace and ordering platform that enables customers (often overseas) to purchase vouchers, meals, groceries, and goods for pick-up or delivery in Samoa. We may:

List products and prices from Vendors;

Sell My Samoa-issued vouchers;

Coordinate delivery/pick-up via Delivery Partners;

Provide customer support and order status updates.

We may change or discontinue any feature at any time.

6) Orders, Acceptance & Availability

Placing an order is an offer to buy. We accept when we send an order confirmation.

If an item is out of stock or a Vendor cannot fulfil, we’ll offer a substitute, delayed fulfilment, store credit, or refund (at our discretion, acting reasonably).

We may cancel any order (e.g., fraud checks, pricing errors, regulatory reasons). You’ll be notified and refunded if payment was taken.

7) Pricing, Currency & Taxes

Prices are shown in NZD or WST (or as displayed) and include GST/VAT where applicable.

Exchange rates, fees, and taxes may apply for cross-border payments.

We may update prices, fees, and promotions without notice (changes won’t affect already-accepted orders).

8) Payment & Security

We accept the payment methods shown at checkout. Your card/wallet provider may charge fees.

We use third-party processors. By paying, you authorise the processor to charge your payment method for the order total, fees, adjustments, or refunds.

Chargebacks: If you initiate a chargeback, we may suspend the account while we investigate. Proven fraudulent or abusive chargebacks may be referred to collections.

9) Vouchers & Credits

Voucher use: redeemable only at participating Vendors/locations and subject to Vendor hours, stock, and redemption rules.

Non-transferable unless expressly allowed; not redeemable for cash except where required by law.

Expiry: Voucher expiry and any special terms are shown on the voucher page/receipt.

Loss/Theft: Treat vouchers like cash; we are not responsible for lost, stolen, or misused vouchers once issued, but we’ll do our best to assist.

10) Delivery & Pick-Up in Samoa

Delivery windows are estimates; weather, traffic, island conditions, events, or Vendor delays may affect timing.

Receiver responsibility: ensure accurate name, village, phone, and availability. If delivery cannot be completed due to incorrect details or no-show, redelivery fees may apply.

Proof of handover: we may require a code, signature, photo, or ID check for security.

Risk & Title: pass to the Receiver upon handover or pick-up confirmation.

11) Substitutions & Product Variations

For groceries/combos, close substitutes of equal or greater value may be offered when exact items are unavailable (we’ll act reasonably and culturally appropriate).

Photos are illustrative; actual packaging or presentation may vary by Vendor.

12) Restricted & Prohibited Uses

You agree not to:

Use the site for unlawful, fraudulent, or harmful activity;

Interfere with site security; scrape or reverse-engineer;

Misrepresent identity or relationship to a Receiver;

Circumvent voucher rules or delivery processes.

We may suspend or terminate accounts for violations.

13) Third-Party Vendors & Links

Vendors are independent. Product descriptions, prices, and quality are primarily provided by Vendors. We curate and moderate but cannot guarantee every detail.

We’re not responsible for third-party websites linked from our site.

14) Returns, Replacements & Refunds

Perishable food & prepared meals: non-returnable; if there is a quality or safety issue, contact us within 24 hours with evidence; we’ll work with the Vendor on a fair remedy (replacement, credit, or refund).

Non-perishable goods: request within 7 days of delivery/pick-up if faulty, damaged, or significantly not as described.

Wrong/short items: report within 24 hours.

Remedies may include replacement, store credit, or refund, subject to assessment and applicable law.

Some items (e.g., custom or hygiene items) may be non-returnable unless faulty.

15) Consumer Rights (NZ & Samoa)

For NZ customers, your rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986 apply. If you are acquiring goods/services for business purposes, the CGA does not apply (to the extent permitted by law).

For Samoa, we honour local consumer protections and will work with Vendors to provide appropriate remedies.

16) Memberships, Promotions & Coupons

Promotions have stated conditions and end dates. We may limit or withdraw offers at any time.

One offer per order unless otherwise stated.

Misuse (e.g., multiple accounts) may void benefits.

17) Intellectual Property

All content on My Samoa (logos, text, images, graphics, software) is owned by or licensed to us. You may not use, copy, or distribute it without our written permission, except for personal, non-commercial use as allowed by law.

18) Privacy

Your use of My Samoa is governed by our Privacy Policy (see “Privacy” in our footer). It explains how we collect, use, disclose, and protect your data, including use of cookies and analytics.

19) AML/CFT, Fraud & Verification

We may conduct identity or payment verification and anti-fraud checks, including for voucher abuse, stolen cards, or money-laundering risk. We may request ID for the purchaser or Receiver and may decline or cancel orders where required by law or our risk policy.

20) Service Interruptions

We aim for continuous availability but do not guarantee the site will be uninterrupted or error-free. We may suspend access for maintenance, security, or operational reasons.

21) Warranties & Disclaimers

To the maximum extent permitted by law, we provide the site and services “as is” and “as available” and disclaim all non-mandatory warranties. We do not guarantee:

every listing’s accuracy or availability at the time of order;

exact delivery times;

compatibility of services with your device or network.

22) Liability

Nothing in these Terms limits rights you cannot lawfully exclude (e.g., under the NZ CGA for consumers). Otherwise, to the extent permitted by law:

We are not liable for indirect, incidental, special, or consequential loss; and

Our total aggregate liability for any claim relating to the services or an order is limited to the amount you paid for that order.

23) Indemnity

You indemnify us (and our directors, staff, and agents) from claims or losses arising from your breach of these Terms, unlawful use, or misuse of vouchers/deliveries, except to the extent caused by our negligence or breach of law.

24) Changes to Terms

We may update these Terms at any time. The latest version will be posted on www.mysamoa.co
 with the “Last updated” date. Continued use after changes means you accept the updated Terms.

25) Suspension & Termination

We may suspend or terminate your account or access for suspected breach, fraud, or risk. You may close your account anytime by contacting support.

26) Governing Law & Disputes

These Terms are governed by the laws of New Zealand. You submit to the exclusive jurisdiction of the New Zealand courts. If a term is unenforceable, the remaining terms continue in effect.
